$15M Medical Malpractice Award in Colorado

A jury in Colorado Springs has awarded $15 Million for a emergency room misdiagnosis that left him paralyzed. The verdict is the largest in Colorado state history.

The actual payout to the plaintiff will be much lower than the $15 Million, as $10 Millions of the amount was pain and suffering. Colorado caps non-economic damages at $300,000. The plaintiff had also settled with the Memorial Hospital for their share before the verdict was rendered.

Social Media Liability

A second London Olympic athlete was expelled for posting a racist comment on Twitter (a social networking website).  The first athlete, a Greek triple-jumper, was also prevented from competing in the games as a result of a post she made on Twitter.  These instances highlight the fact that social media is simply another outlet for discrimination or harassment and should be treated carefully.  InsurePhysicians.com encourages clients to review their own social media policies and purchase employment practices liability insurance for this risk.
